2. INTRODUCTION
This Privacy Policy explains how Oculista Valbom collects and processes the personal data necessary to provide the services offered on the Website (www.oculistavalbom.pt).
The General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, hereinafter “GDPR”) and the GDPR Implementation Law in the Portuguese legal system (Law no. 58/2019 of August 8, hereinafter “LGPD”) ensures the protection of natural persons with regard to the processing of personal data and the free movement of such data.
According to the law, “personal data” means any information of any nature and regardless of its medium, including sound and image, relating to an identified or identifiable natural person, so the protection does not cover data of legal persons.
Oculista Valbom maintains a database with its customer records. The data contained in this database is solely the data provided by customers (Users) at the time of registration, and is collected and processed automatically by Oculista Valbom, the entity responsible for the respective file.
3. PERSONAL DATA COLLECTED, PURPOSES AND GROUNDS FOR LEGITIMACY
The categories of personal data we collect (directly or through third parties) and our privacy procedures depend on your use of the Website and applicable legal requirements.
Oculista Valbom seeks to collect only information that is relevant to the purposes of data processing.

Oculista Valbom guarantees the confidentiality of all data provided by its customers. Although Oculista Valbom collects and processes data securely and prevents its loss or manipulation using the most advanced techniques, we would like to inform you that collection on an open network allows personal data to circulate, running the risk of it being seen and used by unauthorized third parties.
At the time personal data is collected, unless otherwise indicated, the User may voluntarily provide personal data without the lack of response implying a reduction in the quality or quantity of the corresponding services (unless otherwise indicated). However, failure to respond to data considered mandatory will mean that you will not be able to access the service for which it was requested.
If you do not agree to the above conditions, Oculista Valbom cannot enter into a contract with you through the Website.
4. DATE OF STORAGE OF PERSONAL DATA
Your personal data will be kept for as long as necessary for the purposes for which it is collected, in accordance with legal obligations in Portugal.
5. ALLOCATION OF PERSONAL DATA
Oculista Valbom may use third parties to provide certain services, such as maintenance, technical support, marketing, billing management or payments, and may have access to some of the personal data we collect, in particular the data required for contractual purposes.
Oculista Valbom guarantees that the entities that have access to the data are credible and offer guarantees of protection. Oculista Valbom does not transmit data to third parties beyond what is necessary to provide the contracted services, but remains responsible for the personal data that the user provides us with.
Oculista Valbom may also transmit data to third parties in the context of investigations, inquiries and judicial or administrative proceedings, or of a similar nature, arising from a court order.
6. SECURITY MEASURES
Oculista Valbom declares that it has implemented and will continue to implement the technical and organizational security measures necessary to guarantee the security of the personal data provided to it, in order to prevent its alteration, loss, processing and/or unauthorized access, taking into account the current state of technology, the nature of the data stored and the risks to which they are exposed.
Oculista Valbom guarantees the confidentiality of all data provided by its Users, both when registering and when purchasing/ordering products or services. The collection and processing of data is carried out securely and prevents its loss or manipulation. All data is entered into a Secure Server (128-bit SSL) which encrypts it (turns it into code). Users can check that their browser is secure if the padlock symbol appears or if the address begins with https instead of http.
Personal data is processed with the level of protection legally required to guarantee its security and prevent its alteration, loss, processing or unauthorized access, taking into account the state of the art.
Whenever it accesses any personal data, Oculista Valbom undertakes to:
- To store them using legally applicable technical and organizational security measures to guarantee the User’s safety, thus preventing alteration, loss, processing or unauthorized access, in accordance with the state of the technology at any given time, the nature of the data and the possible risks to which they are exposed;
- Use the data exclusively for previously defined purposes;
- Ensure that the data is only processed by employees whose intervention is necessary for the provision of the service and who are bound by the duty of secrecy and confidentiality. If the information may be disclosed to third parties, they must be obliged to keep it confidential in accordance with the provisions of this document.
7. COMMERCIAL AND PROMOTIONAL COMMUNICATIONS
One of the purposes for which we process the personal data provided by users is to send electronic communications with information on visual health, commercial and promotional communications.
Whenever we make such a communication, it will be addressed exclusively to Users who have expressly and previously authorized it.
Under the terms of Decree-Law no. 7/2004, of January 7, if the User wishes to stop receiving commercial or promotional communications from Oculista Valbom, they may request to object to the service by sending an email to the following address: clientes@oculistavalbom.pt.
8. EXERCISING RIGHTS
In accordance with the provisions of the GDPR and the LGPD, the User may, at any time, exercise their rights of access, rectification, erasure, limitation, opposition and portability upon request by any of the following means:

9. TRANSFER OF DATA TO THIRD COUNTRIES
If data is transferred to third countries (countries outside the European Economic Area), Oculista Valbom will comply with the applicable legislation, particularly as regards the adequacy and level of protection applied to personal data in the country of destination. Oculista Valbom will also apply the necessary mechanisms to ensure that transfers are carried out in accordance with the law.
10. MINORS
Oculista Valbom’s services are not intended for minors under the age of 18. We therefore ask that minors do not provide us with any personal information.
11. SUPERVISORY AUTHORITY
